General conditions of services

1. Lender

2. Budget and contract formation
Each installation is previously budgeted according to the needs of the case. Before contracting, IBITIC will provide on a durable medium an offer with the identity of the parties, description and scope, total price with taxes, equipment and materials, third-party services, travel, payment method, indicative calendar and validity. The contract is formed with the express acceptance of the client. Subsequent modifications must be accepted by both parties.
3. Published prices
The amounts “from” are indicative and correspond to the minimum scope described. The website shows the professional price without VAT and its equivalent with VAT at the current general rate. The final price will be that of the accepted budget and may vary due to dimensions, access, wiring, equipment, licenses, travel, schedules or additional work, always with prior information and acceptance.
4. Technical visit and travel
When a technical visit is necessary to inspect the site and prepare the report or proposal, the visit and travel are paid, from €50 + VAT (€60.50 VAT included). The total price will be communicated and must be accepted before arranging it. If the client later accepts the installation estimate, the amount of that visit is deducted from the final price under the conditions indicated in the offer. If the installation is not contracted, the visit already made is charged. A failed visit is also charged when the technician travels and cannot access or work for a reason attributable to the client. Other trips are detailed in the budget.
5. Execution and customer collaboration
The client must provide secure access, information and necessary authorizations, including the legitimacy to act on the property, network, accounts or equipment. IBITIC will execute the service with professional diligence. Deadlines may be adjusted due to unavailability of equipment, operators, third parties, site conditions or unforeseen causes, informing the client.
6. Equipment, materials and third parties
IBITIC supplies equipment only as part of an installation or service with labor; This website does not offer isolated sales of boxed equipment. The quote will identify the equipment, materials, warranties, licenses, operator fees or third-party services included. The conditions of third-party providers – for example Starlink, domain registrars, cloud or software – may also apply when the client contracts with them. IBITIC does not guarantee coverage, speed or availability controlled exclusively by an operator or supplier, without prejudice to the legal responsibility for the equipment supplied and for its own installation.
7. Payment and billing
The payment schedule and conditions are agreed with each client and are included in the accepted budget. For single price jobs, the usual means is bank transfer. Monthly installments are normally charged by direct debit or subscription system, with prior express authorization from the client. When direct debit is used, the client must grant the corresponding mandate; Any change in amount or date will be communicated in accordance with the agreed conditions and payment services regulations.
8. Web plans
Web plans are offered from the advertised price and have a minimum initial duration of 12 months. As a general rule, they are renewed for annual periods, unless the particular contract expressly establishes another periodicity. The client can communicate at any time by email that they do not wish to renew; The cancellation will take effect at the end of the current annual period if the communication arrives before the renewal date. IBITIC will remind you of the next renewal with reasonable notice.
The entry plan can be published on an IBITIC subdomain. If the client wants their own domain, additional features or a different maintenance scope, they will be quoted in the offer. Basic maintenance includes hosting, SSL certificate, technical copies, security updates and a small content change per month of up to 30 minutes, which cannot be accumulated. It does not include redesigns, new sections or functionalities, extensive writing, SEO, campaigns, email, online store or own domain, unless expressly contracted.
If a consumer cancels before ending a permanence commitment, future services not provided will not be charged. The proportional part pending amortization of the initial subsidized creation cost, calculated according to the remaining days, may only be required when it has been previously informed and accepted in the contract.
9. Consumers: withdrawal
When the client is a consumer and the contract is concluded remotely or outside the establishment, they generally have 14 calendar days to withdraw, subject to legal exceptions. If you request that the service begin during that period, you must do so expressly; If you later desist, the proportional amount of what has already been lent may be demanded. The right may be lost when the service has been fully executed, with prior express consent and recognition of that consequence. These rules do not apply to contracts entered into by entrepreneurs within their activity.
To withdraw you can write to info@ibitic.com indicating name, contract details and an unequivocal statement. You can use: “I announce that I am withdrawing from the [service] contract, accepted on [date], in the name of [name], address [address], date and signature if sent on paper.”
10. Compliance and guarantees
Consumers retain all mandatory rights of conformity and guarantee provided for in the regulations. IBITIC will be responsible for the correct execution of its work and, when it supplies goods or digital content/services, for compliance with the applicable legal deadlines. The guarantee does not cover damage due to third-party manipulation, use contrary to instructions, pre-existing failures, force majeure or third-party services, unless legally attributable to IBITIC.
11. Incidents and complaints
Incidents and complaints can be sent to info@ibitic.com, identifying the service and providing sufficient information. IBITIC will acknowledge receipt and seek a reasonable solution. Official claim forms are provided when required.
12. Responsibility
Nothing in these conditions limits mandatory rights of the consumer or liability for fraud, gross negligence, personal injury or cases that cannot be excluded. In professional relationships, each party will be liable for foreseeable direct damages caused by their non-compliance; The budget may establish limits proportionate to the risk of the project.
13. Data and confidentiality
Personal data is processed according to the Privacy Policy. If IBITIC accesses personal data on behalf of the client during support, cloud or maintenance, a processing contract will be formalized where appropriate before access.
14. Law and jurisdiction
Spanish legislation applies. Consumers may go to the competent bodies according to the mandatory consumer and procedural rules. In exclusively professional relationships, the jurisdiction of the courts of Alicante may be agreed when the law allows it.
